Michael Flynn withdraws guilty plea, accuses prosecutors of acting in 'bad faith'

Flynn was charged with lying to the FBI during the Mueller probe.

In a 24-page motion filed Tuesday night, Flynn's attorneys declared his innocence despite pleading guilty twice to making false statements to federal investigators. Flynn's defense team, led by conservative lawyer and frequent Fox News commentator Sidney Powell, has accused the government of forcing Flynn to admit to crimes he did not commit and then hiding evidence that would've exonerated him. A federal judge has rejected those claims.

"The prosecutors concocted the alleged 'false statements' by their own misrepresentations, deceit, and omissions. It is beyond ironic and completely outrageous that the prosecutors have persecuted Mr. Flynn, virtually bankrupted him, and put his entire family through unimaginable stress for three years," according to the motion.

In a tweet Tuesday night, Powell, whom Flynn hired last year, said the government "acted in bad faith, with vindictiveness, and breached the plea agreement."

Last week, prosecutors, who had initially said Flynn should not be sentenced to prison, accused him of thwarting their investigation and of failing to accept responsibility. The government recommended imprisonment "to promote respect for the law and adequately deter such criminal conduct."

Pat Cotter, a former federal prosecutor, said Flynn has "little to no chance of successfully withdrawing his plea."

Flynn pleaded guilty two years ago to lying to the FBI about his communication with Sergey Kislyak, then the Russian ambassador to the U.S., in the weeks before Trump took office.

Prosecutors charged that Flynn lied to FBI agents when he told them he did not discuss sanctions against Russia with Kislyak, and when he said he did not ask Kislyak to delay a vote on a United Nations Security Council resolution critical of Israeli settlements.

He needs to go to jail. A general engaging with the Russians? As the article says, he has little chance of this working.

Trump may pardon him and this may be just the way he does it. That would be my guess. It is hard for Trump to pardon him when he pleads guilty. Once he pleads innocent, Trump can step in.

That is what will happen.

That is what will happen.

You apparently did not get the result of the Mueller investigation. Mueller determined that no member of the Trump campaign colluded with the Russians. That would include Gen Flynn.

Flynn was not convicted of colluding with anyone. Nevertheless he had no business pulling the shit he did. He plead guilty to lying to investigators. He did do that. There is no question. He admitted it.

And Mueller did not say there was no collusion. Here is what he said under oath:

“The president was not exculpated for the acts that he allegedly committed,” Mueller told the House judiciary committee, adding that Trump could theoretically be indicted after he leaves office. “We did not address ‘collusion,’ which is not a legal term,” Mueller added. “Rather, we focused on whether the evidence was sufficient to charge any member of the campaign with taking part in a criminal conspiracy.

That is the point of withdrawing his guilty plea. It seems that he had been threatened and pressured into that plea. We will have to wait and see how that plays out.

Mueller saying they were unable to prove a criminal conspiracy by the Trump campaign means that they could not prove collusion. They also could not prove obstruction of justice or any other crime.

I did not have to depend on reporting by FOX News. The complete Mueller hearing was televised and I watched it.

Yes it was a disaster for the Democrats, who wanted to use it to impeach President Trump. That is why they moved on to the Ukraine phone call. But that has turned into a farce by lying "shifty" Adam Schiff and nervous Nancy Pelosi, who repeats the same lies.
