A factory owner, to increase profits, knowingly uses in the manufacturing process a substance known to cause cancer or other bodily harm to the workers and/or consumers of the manufactured product.

A decade later, a study of the affected population of workers and/or consumers finds that through cancer deaths or other afflictions, the life spans across the large affected population were or will be cut by a total of 100 years. Therefore, it seems equitable that 100 years be cut from the life span of the factory owner, which would only be possible through the implementation of the death penalty.

It's not always so black & white. Lots of things "could cause cancer" in particular circumstances.

You can't just so easily classify everything so easily into "good" for the environment, or "bad". And government regulations can often apply to very borderline situations. (i.e. one thing is illegal, while something else that's almost as bad as it is legal)

Sometimes we can get into some real grey zones.

In China right now, the government officials have often been turning a blind eye to pollution, as a matter of policy. China's whole legal system is actually pretty totalitarian, harsh, and dysfunctional, and they know if they brought the full weight of their legal system down on enforcing existing regulations (which by the way are pretty scant compared to places like the US and Europe) it would end up crushing their industry and severely impinge on their economic growth.
