But more importantly, because saying so from the get go will forever leave her as a diversity justice and implies she'd not be named justice had her not being black or a "her".

So what? For some reason you cling to this meritocratic supreme court nonsense.

Here's where affirmative action is actually wrong: At universities.

One of the sources of legitimacy of any highest court is precisely that the justices are top jurists and not just chosen because of political reasons or some quota. Again, even the first SCOTUS had some of the top jurists of its time.

That appointments are political are not something new at all - after all, they are nominated and confirmed by politicians -, but the above is something that's widely expected by the public.

Let's say you have a 1000 "top jurists" in the US (whatever that means). So you cannot pick the black woman out of those and explicitly say it's to fulfill some quota and/or because of her political views?

Because obviously that's the truth and everybody with half a brain knows it.

First you say you'll pick one of the 1000, actually, then you pick her without making any reference to her identity classes and instead justify it based on her career so when in the future she's accused of being a diversity justice she'll be able to say that's not why the POTUS her. Even better, pick her precisely because of her career which is also something that will be taken into consideration I'm sure. After all, the current black SCOTUS justice is not a guy progressives are particularly fond off and what Biden and the Democrats truly care about is getting a justice who's ideologically aligned with them, and that's something that can be inferred from the candidate's career.
