I think it is so incredibly appropriate that the reactionaries who aren't going "lol owned libs" are saying they just really care about abortion. It so perfectly representative of the reactionary mindset that the only people they care about do not exist, and that they cease to care when they do.

You are literally pretending to care about the ~the babies~ because it's a good excuse to take womens' reproductive rights away from them.

The GOP doesnt just want to punish women, they want to punish people for being born poor. They take away their rights and then ensure they have no support because they genuinely believe government is unable to help. Which is true, when they are in power.

Women knowing that their fundamental right to bodily autonomy is going to be taken away is not a "spasm of senseless rage."

No, I'm an Authoritarian Statist of a Socialist, who wouldn't be doing much talk at all if I and people like me were in charge. Worship is great, the ideas have to come from somewhere, and they do. Policing has to be changed, but the answers to the larger problem have to be solved.

I wonder how will this affect the election.

If Trump doesn't manage to get a justice before the election, I assume Never Trumpers within the GOP would have an incentive to vote for him since even if they got 4 more years of Trump, they would in exchange get a SCOTUS that is clearly Republican, although he would also be failing to deliver on his promise to always strive to get judges at the bench. Democrats would also have an incentive to go out and vote, particularly those that are moderate and may be really unhappy with the party's performance during the riots over the summer but who understand that having 6 GOP-aligned SCOTUS justices would be disastrous in the longer term.

OTOH if Trump does manage to get a replacement before the election, Never Trumpers would not have any reason to vote for him come November (after all, even if Biden won the SCOTUS would be aligned with the GOP) and those who voted him to get as many Republican justices at the SCOTUS would still probably vote for him (they were likely going to do it anyway, since they should be happy he already got 2 justices and they would likely do everything they can to stop a Democratic administration even if they didn't like Trump that much). Democrats, moderates and progressive hardliners alike, would be pissed off at this prospect and would harden their opposition to Trump - and the former may be willing to forget about the party's and its elected local officials' behavior during the riots since this is even more important than that. And apart from these, if the election was heavily contested then I would guess the SCOTUS would be more likely to rule for Trump too, if things came to be like in the 2000 election.

Are there any other scenarios to consider? I can imagine the upcoming fight over the SCOTUS being more important than the BLM protests or the pandemic this time around, since however these two things (along with many more problems) are dealt with depends on the composition of the SCOTUS.

It would all depend on whether the Democratic House feels there has been abuse of process and repudiates, refuses to act on, a 6-3 conservative majority Trumpist Supreme Court ruling disposing of the objections to the count.

Note that, "No votes or papers from any other State shall be acted upon until the objections previously made to the votes or papers from any State shall have been finally disposed of." (3 U.S.C. § 15).

Because be under no illusions the US supreme court is a governing body. Having her life and death matter to such an extent politically is a ridiculous way to run a constitutional system.

The Republican caucus on the supreme court have played their hand brilliantly. The Republican establishment really cares about two things, tax cuts for the rich and the security of the Jewish state. They realised that both abortion and gay marriage could become electoral liabilities for the Republicans, hence the Republican caucus made sure there was and remains a majority for Roe-Wade and for Gay Marriage.

I hold constitutionalism in utter contempt. By constitutionalism I mean the anti democratic fascistic idea that there are timeless moral or constitutional principles that can and should be decided outside of the democratic system. Slavery, citizenship rules, abortion and marriage are all political issues that will always be decided politically what ever a farce of a constitution you have in place. Unfortunately in Britain we are ever keen to follow in the foot steps of American cretinism. Americans sure come up with some dumb ideas, but seemingly never too dumb for us British not to want to copy them.
